Terms of Service

These terms apply to all services provided by [Company name / Your full name] under the NebulaNodes brand at nebulanodes.cloud, including free and paid Minecraft server hosting, the API and customer support.

You log in with your Discord account. You must be at least 16 years old, or have permission from a parent or guardian, to create an account. You are responsible for keeping your Discord account secure (we recommend two-factor authentication) and for all activity under your account, including actions of users you give access to your servers and actions made with your API keys.

• Free plan: one free server per person, provided as-is without guaranteed uptime. Creating multiple accounts to get additional free servers is not allowed. Inactive free servers may be stopped automatically and deleted after prior notice.
• Paid plans: you choose the resources (RAM, CPU, storage) yourself and a billing period of 30, 60, 90 or 180 days or one year. The whole period is paid in advance from your account balance. Longer periods are discounted on the 30-day price (60 days 5%, 90 days 8%, 180 days 12%, one year 20%). Paid servers renew automatically for the same period from your balance until cancelled; you can change the period for later renewals at any time. You can cancel at any time, effective at the end of the current billing period. If a renewal cannot be paid, the server is suspended and deleted together with its backups 7 days later unless it is renewed. Resource changes during a period are charged or credited pro rata. Remaining paid time is not refunded when you delete a server yourself.
• Storage: every server has a storage limit. Uploads that exceed it are refused, and a server that uses clearly more storage than its limit may be stopped until files are deleted or the storage is upgraded.
• Modpacks installed with the modpack installer are provided by their authors via Modrinth. We do not check their content and are not responsible for it. Installing a modpack replaces the mods, configs and server software of the server.
• Coupons and gift codes can only be redeemed under the stated conditions and cannot be exchanged for cash.

Prices shown include statutory VAT where applicable.

• You can top up your account balance via our payment provider Stripe. Top-ups are credited after the payment has been confirmed. You receive an invoice for every top-up.
• Before your first purchase you must enter your name and billing address in the dashboard. They are shown on your invoices and must be correct.
• Balance can only be used for services on NebulaNodes and cannot be transferred to other accounts. When your contract ends (for example when you delete your account), we pay out unused balance that you topped up yourself on request, free of charge, to the original payment method or by bank transfer. Credit you received for free (gift codes, referral rewards, goodwill credits) is not paid out.
• If a payment is reversed or refunded, the corresponding amount is deducted from your balance, even if this makes it negative.

You can earn balance by inviting new users with your referral link. A reward is credited once the invited user creates their first server. Referrals of yourself, of accounts from your own network, of Discord accounts younger than 7 days, or obtained through spam or misleading advertising are not rewarded. We may change or end the program and reverse rewards obtained through abuse.

Right of withdrawal. If you are a consumer, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day the contract is concluded (for paid servers: the day you order the server or the upgrade; for top-ups: the day of the payment).

The easiest way is our withdrawal function ("Withdraw from contract", also linked in the dashboard and at the bottom of every page). Alternatively, to exercise the right of withdrawal, you must inform us

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient that you send your notice of withdrawal before the withdrawal period has expired.

Effects of withdrawal. If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and at the latest within 14 days from the day on which we receive your notice of withdrawal. We use the same means of payment as you used for the original transaction, unless expressly agreed otherwise; you will not be charged any fees for this reimbursement. If you requested that the service begins during the withdrawal period, you shall pay us an amount proportionate to the services provided until you inform us of your withdrawal, compared to the full scope of the contract.

Immediate start of paid servers. A paid server only starts before the withdrawal period ends if you expressly request this at checkout and confirm that you are aware of the consequences. In this case your right of withdrawal expires once the service has been fully provided (§ 356 (4) BGB). We keep a record of your confirmation.

Top-ups. If you withdraw from a top-up, we refund the part of the balance that has not yet been used for services.

Paid servers. If you withdraw from a paid server or an upgrade that started at your request before the end of the withdrawal period, the amount you pay for the time used is calculated as: price paid × days used ÷ days of the billing period (rounded down). The rest is refunded.

How you get your money back. By default we refund to the payment method you used (for paid servers: the top-ups that funded your balance). In the withdrawal form you can instead choose to receive the refund as balance on your account. This is entirely your choice and is never required.

• Access to the API must be requested in the dashboard and is granted at our discretion. We may refuse or revoke access, for example in case of misuse. Revoking access disables all API keys of the account.
• Keep your API keys secret. You are responsible for everything done with them. Revoke a key immediately if it may have been leaked.
• Rate limits apply. Automated use must not put an unreasonable load on our systems or be used to get around limits of your plan.

Support is provided via tickets in the dashboard. We answer as soon as possible but do not guarantee response times. Customers with an active paid server are prioritised. A ticket that waits for your reply for 7 days is closed automatically; you can reopen it at any time by replying. Never share passwords or API keys in a ticket.

You may not use our servers to:

• Host illegal content or infringe the rights of others
• Run DDoS attacks, port scans, crypto mining, or other abusive workloads
• Attack, probe or interfere with other customers' servers or our infrastructure
• Distribute malware or operate phishing or spam services
• Violate the Minecraft EULA or Mojang's usage guidelines

We may suspend servers that violate these rules, with or without prior notice depending on severity.

Reports and moderation (Digital Services Act). We do not check content on customer servers in advance. Anyone can report illegal content or abuse via our report form or by email to contact@nebulanodes.cloud, which is also our single point of contact for authorities and users (English and German). We review reports without undue delay and decide carefully and objectively. Possible measures are a warning, stopping the server, suspending the server or, for serious or repeated violations, terminating the account. We inform the affected customer about the measure, the facts and the reasons, and how to object to it (support ticket). We inform the reporter about our decision if they gave us an email address. Obviously unfounded reports may be ignored.

You keep all rights to worlds, plugins, and files you upload. You grant us only the rights needed to store, back up, and run them. You are responsible for ensuring you have the right to use any content you upload.

For personal data of your players that your server stores, you are the controller and we act as your processor. Our data processing agreement (Art. 28 GDPR) applies; you can conclude it in the dashboard under Settings → Data processing.

We aim for high availability but cannot guarantee uninterrupted service. Scheduled maintenance is announced in advance where possible. We do not back up your servers for you. You can create backups in the dashboard (manually or automatically every 2 days) and are responsible for keeping your own copies of important data.

We are liable without limitation for intent and gross negligence, and for injury to life, body, or health. For slight negligence, we are liable only for breaches of essential contractual obligations, limited to typical, foreseeable damage. Liability under the German Product Liability Act remains unaffected.

You can cancel the automatic renewal of paid servers at any time with effect at the end of the paid period, in the dashboard or via Cancel contracts here, which works without logging in. You can delete your account at any time under Settings → Your data in the dashboard, or ask us to do it by email or support ticket. Deleting your account deletes all of your servers immediately. Remaining paid time of servers is not refunded, unless you are entitled to a refund under section 6 or by law. Unused balance you topped up yourself is paid out on request as described in section 4; please request this before you delete your account or afterwards by email to contact@nebulanodes.cloud. We may terminate accounts for serious or repeated violations of these terms. After termination, server data is deleted within 30 days.

• Prices of paid servers apply per billing period. A new price only applies to periods that start after we have announced it at least six weeks in advance. Until then, you can turn off the automatic renewal at any time; the period you already paid for is not affected.
• These terms may be changed for good reason, for example because of new laws, court decisions, new features or security requirements. We announce changes at least six weeks before they take effect, in the dashboard and by email if we have your address, and explain what changes.
• You can object to a change until it takes effect. If you object, the previous terms continue to apply until the end of your paid period; we may then end the contract at that time, and you get unused balance back as described in section 4. You can also cancel without notice, free of charge, at the time the change takes effect. Changes to the main obligations (what we provide and what it costs) are never made without your consent.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection laws of your country of residence remain unaffected. Questions? Contact contact@nebulanodes.cloud or read our Privacy Policy.
